Description of Project:

The EU and Moldova started negotiations on an association agreement. As part of this, the EU launched negotiations with Moldova on a deep and comprehensive free trade area (DCFTA)

Overall objective
To support the implementation of the DCFTA .

Purpose
Purpose 1: Provide additional specialised capacity to the sector units involved in the DCFTA
Purpose 2: Ensure that Moldova fulfils all its commitments under the DCFTA

Results to be achieved by the Consultant
1. Working Group (WG) meetings well prepared and followed up: The WGs were established by the MoE aiming at the fulfilment of the Action Plan for implementing the EC key and additional recommendations for the negotiations of the DCFTA (Action Plan). For this purpose we shall provide specialised expertise coming from the roster of senior experts and from the Central Policy Unit.
2. Policy and legal approximation advanced according to DCFTA: The Consultant will offer advice in the creation of the strategic framework for policy and legal approximation. Subsequently key priority laws will be targeted by the Project and appropriately amended through technical assistance.
3. Capacity to implement the DCFTA increased: The Project will contribute to capacity building in the beneficiary and partner Ministries in charge of coordinating and implementing the provisions of the DCFTA.
4. Monitoring of DCFTA implementation enhanced. Inter and intra ministerial coordination improved.
5. Priorities set in coordination with the MoE and relevant stakeholders. Activities are sub-divided into appropriate tasks and sub-tasks for better implementability.
6. Actions to implement DCFTA are coordinated with the NDS and other National and bilateral strategies as well as sector strategies. Relevant laws are drafted and approximated with special emphasis on secondary and enforcing legislation. Bottlenecks for DCFTA implementation are identified and appropriate administrative or legal actions are proposed for their removal.
7. Awareness strategy is implemented, and as a result there is better comprehension from stakeholders, business, consumers and the general public of the benefits from DCFTA and legal approximation.

Component 1. Provide research and policy advice to groups of officials involved in implementing the Deep and Comprehensive Free Trade Area (DCFTA)

Task 1.1. Provide Sector Research and Policy and Legal Advice on DCFTA

-     Finalise the template of sector papers

-     Provide regular updates of sector papers

-     Provide policy and legal advice

Task 1.2.  Establish priorities for the implementation of the DCFTA

-     Review Plan for DCFTA implementation

-     Divide sector actions into tasks/subtasks and establish priorities

-     Constantly update priorities/actions/tasks and subtasks

Task 1.3. Support DCFTA monitoring and coordination

-     Provide analysis of the institutional and administrative problems 

-     Establish policy coordination mechanisms and attend progress meetings

Task 1.4. Support  activities of the WGs formed by the MoE on sector policies development 

Component 2. Draft and Approximate legislation, analyse and present European body law, compare and suggest amendments to Moldovan law

Task 2.1. Assist approximation based on prioritisation of the DCFTA 

Task 2.2. Enhance the capacities of the MoE, line ministries and other public institutions in the approximation process

Task 2.3. Strengthen the capacities of the civil servants in drafting legal acts for approximation
