Description of Project:

The global objective of this project is to accelerate legal and regulatory reforms in the area of trade, competition, state aid and consumer protection in compliance with the Acquis Communautaire and WTO requirements.
The specific objective of this project is to prepare Terms of Reference for a technical assistance project, to be launched in mid 2007, whose main purpose would be to:
- Improve the legal and regulatory environment in the areas of trade, competition, state aid and consumer protection;
- Build the required administrative capacity in Montenegro to progress internal market and trade matters in the Stabilisation and Association Agreement - and WTO accession and post accession processes.
The Project was executed in the course of three successive missions to Montenegro from October to December 2006, by a team of five experts. Main activities were as follows:
- Assessment of the current state of play concerning the legal/regulatory framework and administrative procedures established in the areas of trade, competition, state aid and consumer protection, concerning the commitments undertaken by Montenegro vis-à-vis the EU Stabilisation and Association Agreements and the WTO accession.
- Design of a concept of a technical assistance project to be financed by the CARDS Programme, assuring continuity of technical assistance with the Instrument of Pre-Accession Assistance interventions that will be made available from 2008 onwards.
- Preparation of technical specifications for the procurement of equipment for public administration organisations of Montenegro.
- Preparation, in consultation with prospective beneficiary organisations (Montenegrin public administration authorities) of Terms of Reference and related documentation (procurement notice, budget estimates), for a technical assistance project, focusing on the development of legal regulatory framework and institutional development in the areas of trade, competition, state aid and consumer protection

Services Provided:

- In depth assessment of the potential beneficiary institutions and preparation of a Status report summarising priority work needed for legal approximation to the acquis communautaire and for WTO accession process.
- Consultations with potential beneficiary Montenegrin institutions, involved in the areas of trade, competition, state aid and consumer protection, to identify priorities to be addressed by future technical assistance projects
- Consulting services to the European Agency for Reconstruction concerning the design of a future technical assistance project, and preparation of corresponding Terms of Reference and related documentation.
