Description of Project:
|
The Project strategic goal is the progressive approximation of the Russian to the EU competition policy, and the strengthening the co-operation between the EU and Russian Competition Authorities with the view to pursuing multilateral co-operations to which the EU is also part. The Project specific objectives are:
- The improvement of the policy and legal and regulatory framework in the sphere of competition & state aid and their approximation with the EU rules.
- The improvement of the internal structure of the Competition Authority (FAS), with the view to enforcing effectively the competition rules, including state aid control and regulation of the natural monopolies.
- The dissemination of information with the view to increasing awareness among the economic operators.
- Enhancing co-operation between the Russian and EU Competition Authorities.
The project is organised through four different components with the following activities:
1. Development and Approximation of Competition legislation:
- Review of Russian legislative and regulatory framework for competition, state aid and regulation of natural monopolies;
- Comparative analysis of Russian and EU competition rules and systems is conducted;
- Revised comparative analysis for Antitrust legislation/State Aids;
- Policy concept in line with EU rules, and in the perspective of the CES for competition rules, state aid control and natural monopolies is presented;
- A plan of action, setting out policy, primary and secondary legislation measures improving competition rules, state aid control and regulation of natural monopolies in line with EU rules is prepared;
- Plan of Action is implemented including drafting of primary and secondary legislation, in line with the EU rules is drafted.
2. Enforcement and Institutional Capacity Building:
- Recommendations for improvement of institutional arrangements are presented;
- Recommendations on optimisation of FAS federal and regional structures are presented.
- Recommendations for enhancing the enforcement of competition rules are presented;
- A train-the trainers programme for 20 trainers and a training programme for 200 competition officials and representatives of the judiciary are conducted;
- A distance learning training system is elaborated, implemented and integrated into the competition authorities training process.
- A training function is established in FAS.
3. Information and communication component:
- A roadmap for transparency and publicity of competition policy is presented, adopted and implemented;
- A dissemination plan is presented and implemented throughout the duration of the project;
- Regular "competition roundtable" sessions are organised on specific and concrete competition issues-including natural monopolies and state aid - and relevant documentation are produced and disseminated;
- An international conference on competition is organised once a year;
- Annual Observatory of FAS and information booklets are prepared and published;
- The efficiency of the Information Centre at FAS is enhanced.
- Annual reports on state aid at national and local levels are presented.
4. Enhancing Russian-EU Cooperation component:
- Internships & study tours in EU competition authorities organised for at least 20 officials.
- Participation of high-ranking Russian competition officials in international conferences and consultations with EU officials is organised at least four times a year.

- Review of Russian Legislation and Comparative Analysis with EU competition systems on Antitrust legislation/state aids and on Natural Monopolies (Electronic Communications, Postal Communications, Energy-Electricity, Energy-Gas, Railways)
- Policy Concept in line with EU rules and in the perspective of the CES for Antitrust and State Aids legislation, Natural Monopolies
- Plan of action setting out policy, primary and secondary legislation measures required to improve competition rules, state aid control and regulation of natural monopolies in line with EU rules regarding Primary and secondary legislation drafting, Antitrust Legislation and State Aids
- Recommendations for the improvement of institutional arrangements to facilitate for better functioning competition environment including based on an Inventory of federal bodies involved in competition rules and assessment of overlapping of competences.
- Recommendations for the optimisation of the FAS federal and regional structures and Recommendations for enhancing the enforcement of competition rules
- Training needs analysis and Training Programme for FAS officials and members of the judiciary across RF and train-the-trainers sessions
- A distance learning training system is elaborated, implemented and integrated into the competition authorities training process
- Improvement of the FAS in-training facility
- Roadmap for transparency and publicity and Dissemination plan and roundtable discussions organised
- Two international conferences organised in Moscow
- Annual Observatory of FAS and information booklets for enterprises and for Regional / Local Authorities on State Aids
- Annual reports of FAS activities published
- 2 Study tours in EU countries, 10 internships for FAS staff realised, Participation in international conferences and consultations (8 bilateral meetings)
